The European Banking Authority (EBA) is an independent EU authority established in 2011 under Regulation (EC) No. 1093/2010, with subsequent amendments. It plays a crucial role in ensuring the stability, transparency, and effective regulation of the EU financial system, working closely with other EU financial regulators such as EIOPA, ESMA, and the ESRB.
The EBA is currently seeking a Head of Legal Unit to be based in its London office. This role is essential for providing legal support to the governing bodies, management, and core policy and operational functions of the EBA. The successful candidate will act as the Legal Counsel and be responsible for managing legal work, advising on EU and national laws, and ensuring compliance with the EBA's Founding Regulation.
Main Purpose
The Head of Legal Unit is tasked with:
- Ensuring a sound legal environment for the EBA’s operations
- Identifying and preventing legal risks
- Proposing and developing solutions to legal challenges
- Formulating the EBA’s ultimate legal position on matters related to its functioning
- Providing legal support to regulatory and supervisory activities
Main Responsibilities
- Assessing and translating strategic needs into work plans
- Implementing the unit’s strategy in line with EBA’s mission and EU legislation
- Acting as Legal Counsel to the EBA
- Coordinating with EU institutions, bodies, and the host state
- Representing the EBA in legal disputes and before relevant EU courts and offices
- Providing legal advice to management, operational functions, and the Mediation Panel
- Drafting and interpreting implementing rules, agreements, and decisions
- Managing and developing the team's legal competencies
Requirements
1. Eligibility Criteria
- Must be a national of an EU member state, Iceland, Liechtenstein, or Norway
- Must be physically fit and have no criminal record
- Must have completed university studies in Law and have appropriate professional experience
- Must demonstrate proficiency in at least two EU languages (English is required)
2. Selection Criteria
- Proven knowledge of EU banking regulation and administrative law
- Experience in legal analysis of financial and supervisory proposals
- Experience in drafting legislative proposals
- Experience in a legal department dealing with financial regulatory matters
- At least five years in a comparable managerial or team leader role
3. Competencies
- Ability to analyze complex information and propose solutions
- Ability to present to senior management
- Ability to set and monitor objectives for the unit
- Ability to motivate and empower team members
- Strong sense of responsibility, confidentiality, and cooperation
- Flexibility and proactive attitude

Selection Procedure
- A selection committee will assess applications based on CV, motivation letter, and eligibility grid
- Shortlisted candidates may be invited for written tests and interviews
- Written tests are in English and evaluate communication, knowledge, and drafting skills (minimum score: 6/10)
- Interviews are in English and assess suitability, knowledge, and motivation (minimum score: 6/10)
- Successful candidates will be ranked by merit, with top scorers being recruited and those scoring 12 or above placed on a reserve list valid until 31 December 2014
Appointment and Employment Conditions
- Contract: Temporary fixed-term for 3 years with a 9-month probation period, possible extension
- Expected start date: 1 March 2014
- Grade: AD 10
- Estimated monthly basic salary: €8,064.86
- Employment benefits include:

Appeal Procedure
- Candidates may appeal decisions under:
- Article 90(2) of the Staff Regulations (complaint to EBA)

- Appeals must be submitted within 3 months of notification
- The European Ombudsman can also be contacted for complaints, but it does not suspend the time limits for appeals
