EBA Legal Expert Position Summary

The European Banking Authority (EBA) is an independent EU authority established on 1 January 2011 under Regulation (EC) No. 1093/2010, published in the Official Journal of the European Union on 15 December 2010. It plays a key role in ensuring high-quality, effective, and consistent regulation and supervision in the areas of banking, payments, e-money, and related corporate governance, auditing, and financial reporting. The EBA collaborates closely with other European Supervisory Authorities (ESAs), including EIOPA and ESMA, and is part of the European Systemic Risk Board (ESRB) framework.

Main Purpose

The Legal Expert position is aimed at providing legal analysis and support to the EBA's regulatory and oversight functions. This includes drafting binding technical standards, guidelines, recommendations, and opinions, as well as supporting supervisory activities and dispute resolution.

Main Responsibilities

• Providing legal support in the drafting of regulatory documents
• Offering legal analysis of proposed standards, guidelines, and recommendations
• Participating in EBA working groups and cooperating with other ESAs
• Representing the EBA at a technical level
• Performing other related legal tasks

Requirements

1. Eligibility Criteria

• Language Proficiency: Excellent knowledge of English (written and spoken), and satisfactory knowledge of another EU language
• Nationality: Must be a national of an EU Member State, Iceland, Liechtenstein, or Norway
• Legal Qualifications:
  • a) Completed university studies in law with a diploma and at least one year of professional experience (if normal education is 3 years)
  • b) Completed university studies in law with a diploma (if normal education is 4 years or more)
• Professional Experience:
  • At least 13 years (for a) or 12 years (for b) of relevant full-time experience, including at least 5 years in a comparable position in banking supervision or regulation
• Criminal Record and Medical Examination: Must provide a certificate of no criminal record and undergo a medical examination

2. Selection Criteria

• Proven knowledge of EU banking regulation
• Experience in formulating policy positions
• Experience in drafting regulatory papers, memos, and briefings
• Legal analysis skills for financial regulatory and supervisory proposals
• Experience in providing legal advice to senior management
• Ability to present to senior management on relevant developments
• Experience in dealing with a wide range of stakeholders

Selection Procedure

• A selection committee will evaluate applications based on CV, motivation letter, and eligibility criteria grid
• Shortlisted candidates may be invited to written tests and interviews
• Written Tests: Conducted in English, total score 10, minimum passing score 6
• Interviews: Conducted in English, total score 10, minimum passing score 6
• Successful candidates will be ranked by merit, with the top scorers being recruited
• Candidates scoring 12 or above will be placed on a reserve list valid until 31 December 2013

Appointment and Employment Conditions

• Contract Type: Temporary agent fixed-term contract for 3 years with a 6-month probation period, possible extension
• Expected Start Date: 1 March 2013
• Grade: AD 9
• Estimated Monthly Salary: €7,127.99 (basic salary)
