EU Directive on Platform Workers
Overview
On March 14, 2024, EU-27 employment and social affairs ministers agreed on a new directive to improve working conditions for platform workers. This directive addresses employment status, algorithmic management, and worker rights.
Key Updates
- Employment Status: Determination will now be handled by each EU member state, establishing a legal presumption of employment when control is evident. Strategies use national law and EU case law to assess status; digital platforms must prove no employment relationship exists.
- Algorithmic Management: Safeguards include data privacy restrictions, greater transparency in automated systems, and human oversight for decisions affecting workers.
- Background: Proposed by the European Commission in December 2021, negotiations concluded in February 2024 after issues over unclear criteria were resolved.
Implications
The directive aims to address misclassification, with over 5 million potentially wrongly categorized as self-employed. Companies should monitor developments, as rules may affect employment status, algorithmic processes, and contracts with workers.
Next Steps
The directive will be finalized, formally adopted by the Council and European Parliament, and then transposed into national legislation by 2027.
