EBA Guidelines on Summary or Collective Form Information Disclosure
1. Core Mandate
The European Banking Authority (EBA) has issued guidelines (GL) on how confidential information should be disclosed in summary or collective form. The GL apply to a wide range of entities and individuals involved in the resolution process of financial institutions.
2. Scope of Application
The GL are applicable to the following persons:
- Resolution authorities
- Competent authorities and EBA

3. Goals and Main Provisions
3.1. Goals of the Guidelines
- To promote convergence in the practices of disclosing confidential information in summary or collective form
- To allow flexibility, as the types of confidential information and the circumstances of disclosure may vary
- To establish principles that guide authorities in avoiding the risk of identifying individual institutions or relevant entities
3.2. General Rule and Principle-Based Factors
The GL outline a general rule that information should be disclosed in a way that does not identify individual institutions or entities. The guidelines emphasize the use of principle-based factors to assess the appropriateness of such disclosures. These factors are designed to help authorities determine whether information is sufficiently anonymized to protect confidentiality.
4. Public Consultation and Next Steps
4.1. Specific Questions for Public Consultation
The EBA has proposed the following questions for public consultation:
- Do you agree with the principle-based factors outlined in the GL for ensuring that individual institutions are not identified when disclosing information in summary or collective form?
- If not, what other principle-based factors might be useful to introduce?
4.2. Next Steps
- The public consultation period closes on 27 January 2016
- The final version of the GL is expected to be published in Q1 2016
