This document is the EBA/GL/2018/07, which outlines the Guidelines on the conditions to benefit from an exemption from the contingency mechanism under Article 33(6) of Regulation (EU) 2018/389 (RTS on SCA & CSC). The guidelines were issued on 4 December 2018 and became applicable from 1 January 2019, with an updated date of 30 April 2019.
The purpose of the guidelines is to establish the conditions under which payment service providers (ASPSPs) can be exempted from the contingency mechanism, which is part of the Strong Customer Authentication (SCA) and Consent (CSC) requirements under the Second Payment Services Directive (PSD2).

Notes
- The EEA States other than the EU Member States are not currently required to notify their compliance with the EBA Guidelines, but they have done so voluntarily.
- If a competent authority continues to intend to comply after the application date (1 January 2019), it will be considered non-compliant unless:
- (A) The Guidelines relate to an institution or instrument that does not exist in the jurisdiction.
- (B) Legislative or regulatory proceedings have been initiated to bring national measures into compliance.
- Article 16(3) of the EBA’s Regulations requires competent authorities to inform the EBA whether they comply or intend to comply with the guidelines.
- The EBA cannot accept responsibility for the accuracy of the information provided by competent authorities.
