Spain's Digital Nomad Visa Program

Background

Spain introduced Law 28/2022 to promote the startup ecosystem, creating a new visa for digital nomads, effective December 22, 2022. This visa, known as the "teleworking visa," allows foreign nationals (non-Europeans) to live in Spain and work remotely for companies located outside Spain for up to one year. It enables applications for a three-year residence permit, renewable in two-year increments.

Eligibility

The visa is for third-country nationals who wish to perform professional activities remotely using digital systems. Key requirements include:

• Eligible Occupations: Qualified professionals (e.g., graduates with at least three years of experience) or those accepted by enterprises.
• Company Requirements: Foreign companies must have at least one year of real and continuous activity with the worker.
• Employee/Freelance Requirements: Minimum professional experience documented, with a salary received if employed, and terms for remote work specified. For self-employment, the visa holder can work up to 20% in Spanish companies.

Application Requirements

• Documentation includes:
  • A letter from the foreign company authorizing remote work, detailing role, salary, and conditions.
  • Proof of remote work capability and social security coverage (or registration in the Spanish system).
  • Proof of health insurance (travel insurance not accepted).
• The process may take time, with guidance issued on January 18, 2023.

Duration and Residency

• The visa is valid for up to one year, or the actual work period if shorter, and permits remote residing and working in Spain during this time.
• Holders can apply for a three-year residence permit based on the visa, renewed every two years if conditions are maintained.
• The visa facilitates extensions for those wanting to reside long-term.

Tax and Additional Benefits

• The Start-up Law's special tax regime, previously for startups, now extends to digital nomads and their spouses and dependent children.
