As part of this relocation, the EBA is seeking legal services to assist in the lease agreement process for its new offices, which will have a net internal area of approximately 4,500–5,000 square meters.
Main Objective of the Contract
The main objective of the contract is to sign a lease agreement for the new offices in Paris that meets the EBA's requirements and ensures a timely relocation. The legal advisors will provide comprehensive support throughout the project, starting immediately after the contract is signed, with an indicative date of the end of March 2018 for the contract signature.
Scope of Work
The legal advisors will be responsible for the following tasks:
- Review and provide advice on the legal environment in Paris
- Evaluate heads of agreement and draft lease agreements
- Offer legal opinions and guidance on the rights and obligations of the parties involved
- Provide legal advice on all aspects of the lease throughout the project
- Recommend improvements and propose mark-ups to the lease documents
- Offer all necessary legal assistance during lease negotiations
- Interact with relevant authorities on behalf of the EBA
- Represent the EBA before the landlord and other stakeholders
- Ensure the EBA's interests, rights, and obligations are fully protected
- Finalize and secure legal endorsement of the lease agreement
The legal advisors will work from their own premises but may also need to attend EBA premises in London and the new location in Paris. They will collaborate closely with the EBA's property advisors, who will be selected to provide guidance on the Paris office market and suitable space.
Negotiated Procurement Procedure
EBA has initiated a negotiated procurement procedure to select legal advisors for the lease agreement. The process involves:
- Sending procurement documents to selected candidates
- Inviting them to submit a tender
- Only candidates invited by the EBA are eligible to participate
- Candidates must confirm their authorization to perform the contract under national law
- Candidates must demonstrate financial capacity and relevant previous experience
The procurement documents will be dispatched to selected candidates on Monday 19th February 2018. Interested economic operators must register their interest by sending an email to tenders@eba.europa.eu, copied to joseph.mifsud@eba.europa.eu, with their name, organization, postal address, and business description by 12 noon UK time on Monday 12th February 2018. The email must include the reference number EBA/2018/01/LEG/SER/NP.
